The Punjab-Haryana High Court Father-in-law used to force daughter-in-law to have sex, High Court refused to grant anticipatory bail.

The Punjab-Haryana High Court The father-in-law is accused of forcing his daughter-in-law to have sex. The court said that given the seriousness of the allegations leveled against him (father-in-law), he cannot be granted anticipatory bail. If bail is granted, the investigating agency may face obstacles in exposing the truth.

According to a Live Law report, Justice Sumit Goyal said that the decorum and dignity of this bond is maintained with unwavering trust, guardianship and seriousness, while even a mere hint of inappropriate action done inadvertently can be detrimental to such a relationship; expressing desire or proposing, or forcing the daughter-in-law to have sex or making inappropriate comments to any such effect, is a very low level on the part of the father-in-law. The Punjab-Haryana High Court The father-in-law is accused of forcing his daughter-in-law to have sex offences punishable under Sections 323, 354-A, 498-A and 506 of the IPC. It is alleged that the husband of the complainant (woman) misbehaved with her in a drunken state and pressurised the complainant to demand more dowry from her family. 

On the basis of the woman's complaint, the court said that the father-in-law tried to forcefully have physical relations with her. Also, the woman's husband supported these acts and threatened divorce if she protested. After examining the available documents, the court found that when the petitioner (father-in-law) allegedly tried to insult the dignity of the complainant, the woman had recorded the conversation,

in which the petitioner (father-in-law) was saying inappropriate things against the woman. The court said that the material collected so far by the prosecution shows that a pen-drive containing voice recordings between the victim/complainant and the petitioner has been seized, which indicates the commission of the crime by the petitioner. 

Justice Goel clarified that the relationship between father-in-law and daughter-in-law is similar to the relationship between father and daughter, which is based on mutual respect, affection and honour. For the time being, considering the seriousness of the matter, the judge said that granting relief would unduly hinder the rights of the investigating agency to conduct a free, fair and impartial investigation. At the same time, the court rejected the petition of the father-in-law.
