The Allahabad High Court has dismissed the PIL filed
seeking disqualification of 99 Congress MPs, cancellation of party registration
and confiscation of election symbol. The petitioner has been allowed to file a
petition again with detailed details.
This order has been given by the division bench of
Justice MK Gupta and Justice Manish Kumar Nigam on the PIL of social worker
Bharti Devi, resident of Fatehpur.
Congress had issued
guarantee card in Lok Sabha elections.
The petition said that Congress issued a guarantee card
in the Lok Sabha elections 2024. In this, the poor, backward, Dalits and
minorities were lured to vote by making a false promise of giving Rs 8500 per
month after the elections. This act is a violation of the People's
Representation Act.
There was a promise of
giving Rs 8500 every month in exchange for votes.
The guarantee card has the signatures of Congress
President Mallikarjun Kharge and Rahul Gandhi. A receipt was given to the
people along with the promise letter, so that people can be sure that whoever
has this receipt will be given Rs 8500 per month by the party after voting in
favor of Congress.
A complaint was made to the
Central Election Commission earlier.
The petitioner said that a complaint was made to the
Central Election Commission in this regard earlier. The commission had issued
an advisory notice to all political parties on May 2, but Congress and its
allies did not withdraw the guarantee card even after the notice.
Offense under BNS
This act of Congress is a violation of the People's Representation Act and the Model Code of Conduct. It is also a crime under BNS. And The petitioner had given a representation to the Election Commission in this regard. When no action was taken, this PIL was filed.
