The Supreme Court heard the case of rape and murder of a trainee doctor
in Kolkata for the second time on Thursday (August 22). During this, many
questions were raised on Kolkata Police regarding unnatural death and time of
postmortem and tampering with the case diary. The country's well-known lawyer
Kapil Sibal was representing the West Bengal government, but he also had to
face reprimand. Apart from this, the Supreme Court told him to bring along a
responsible officer of Kolkata Police during the next hearing who can give clear
answers. Here we are telling on which questions Kolkata Police appeared under
suspicion.
CBI's allegations.
When the CJI asked for the medical examination report, the CBI said,
"Our problem is that we got the investigation five days after the incident.
During this time the crime scene was damaged. Evidence was destroyed. First
Information report(FIR) was registered after the death of the victim. Crime
scene was videographed under pressure from doctors." The Solicitor General
said that a person had filed a complaint in this case in 2023. This cannot be
ignored. On this, Kapil Sibal asked for a copy of the complaint. However, he
did not have any concrete answer about this.
Why was the crime scene sealed after 12 hours.
During the hearing, it was asked that the time of death is written as
10.10 am in the case diary, but the crime scene was not sealed till 11 pm. What
was the police doing. The Supreme Court said that we are looking at your
records. This was not an unnatural death. If it was so, then what was the need
for post-mortem. When the court asked the time of post-mortem, Sibal told
between 6-7 pm and said that the case of unnatural death was registered at 1:45
pm. The Supreme Court said that post-mortem is done before the registration of
unnatural death. This is surprising. Talk to your officers if this is the fact.
The court told Kapil Sibal to speak responsibly and not make any statements.
During the next hearing, bring a responsible officer of Kolkata Police along
with you. Because till now the court has not come to know when the case of
unnatural death was registered.
Demand for investigation of case diary.]
The GD entry in the case diary is at 5:20 am, at 10:10 am, information
was received from the hospital that the woman was lying in a semi-nude state.
When the time of post-mortem and unnatural death could not be made clear, the
court said that the CBI should investigate the case diary and find out whether
some pages have been added to it later. Justice Pardiwala asked why she worked
in this way.
Kapil Sibal reprimanded for laughing.
Tushar Mehta was presenting his point regarding the entry of post-mortem
and unnatural death. He said that the FIR was not lodged by the hospital, but
was registered after the request of the victim's father. How can you laugh. It

Earlier in the hearing on Tuesday, the Supreme Court had reprimanded the
West Bengal government for the delay in registering the FIR. Taking suo motu
cognizance of the matter, the Supreme Court had said that this incident raises
a systemic issue regarding the safety of doctors across India. The bench headed
by Chief Justice DY Chandrachud had said that if women are not able to go to
work and the working conditions are not safe, then we are depriving them of
equality.
